sanwacompany ltd. (hereinafter “sanwacompany” or “we”) aim to provide our customers with better living space with our products. As part of the service, it is our responsibility to protect personal information that we use for the execution of our operations. We thus have established “Basic Principles” and “Handling of Personal Information” to be applied when handling personal information. We declare that we strive to observe these and protect personal information.

Basic Principles

  1. Definition of Personal Information
    “Personal information” means information about a living individual which can identify the specific individual by name, date of birth or other description contained in such information (including such information as will allow easy reference to other information and will thereby enable the identification of the specific individual).
  2. Acquiring, Use and Disclosure of Personal Information
    1. We will acquire personal information by fair and legitimate means.
    2. We will clarify the purpose of use of personal information as far as possible when acquiring such information, and except when required by law, such information will only be used or provided according to the purpose approved by you.
    3. When acquiring personal information from you, we will notify you of the purpose of use of such information directly or publicly announce it on our web page and other means.
  3. Management of Personal Information
    1. We will implement and maintain the appropriate measures to protect personal information from leakage, loss, damage and other risks.
    2. We will not disclose your personal information to third parties without your prior consent except on justifiable grounds.
  4. Compliance with Laws and Regulations
    To protect personal information, we will comply with all legal ordinances and guidelines of government authorities concerning personal information.

    We will establish and operate a Personal Information Protection Management System, and conduct regular audits of it in order to continue to improve upon it.

    We will establish Personal Information Enquiry Desk and make all reasonable efforts to deal with your complaint or consultation about our handling of personal information appropriately and promptly.

Handling of Personal Information

We recognize that protection of personal information is part of our social responsibility. We properly handle personal information based on followings and endeavor to protect it.

  1. Acquisition of Personal Information

    Under the following cases and when necessary for our business operations, we may acquire personal information from you. Provision of personal information is optional; however, if you choose not to provide us with certain personal information, there is the possibility that you may not be able to make use of our services.

    • When we are asked by you by internet, email, telephone and facsimile for inquiry, request, quotation, order and others;
    • When you come our showrooms;
    • When you visit various events we participate in or hold; or
    • When you answer questionnaires conducted by us.
  2. Purpose of Use of Personal Information
    1. In principle, we will use the acquired personal information within the scope of the following purpose of use:
      • To issue the estimate sheet, send our products, settle and repay fee, contact you about a transaction, and the like;
      • To provide or undertake after-sales services and maintenance of our products;
      • To introduce our products and services by sending email, direct mail, catalog and the like;
      • To investigate your usage and satisfaction of our products and services by executing questionnaire survey;
      • To deliver campaign presents or other forms of presents to you;
      • To analyze various marketing data;
      • To ask for an interview to gather construction examples and customer feedback to be published in our advertisement; or
      • To answer your various inquiries and offers.
    2. With the exception of the following cases, we may use personal information for a purpose other than the purposes set forth the preceding paragraph:
      • When your prior consent is given;
      • When required by laws and regulations;
      • When it is necessary to protect the life, body or property of a person, and it is difficult to obtain your consent;
      • When it is specially necessary for the improvement of public hygiene or fostering healthy children, and it is difficult to obtain your consent; or
      • When it is necessary to cooperate with a government organization, local authority or a person authorized by such body so that legally prescribed tasks can be executed, and where there is concern that obtaining your consent may hinder execution of the particular task.
  3. Provision of Personal Information to Third Parties

    We will not provide personal information to any third party, except in the following cases:

    • When personal information is provided to subcontractors (including sub-subcontractors) following an entrustment the handling of personal information in whole or in part within the scope necessary to achieve any of the purposes listed in Section 2. (1) above;
    • When personal information is provided following a business transfer due to a merger or other reason; or
    • When any of the cases provided in Section 2. (2) (a) to (e) exist.
  4. Management of Personal Information
    1. In addition to establishing Personal Information Protection Regulations, we will appoint responsible persons in each of our departments to handle your personal information, and build an appropriate personal information management system.
    2. We will take measures to limit access to personal information by our officers and employees, prohibit the take-out of personal information by them and other measures, and carry out necessary and appropriate supervision of our officers and employees to prevent leakage of, loss of, damage to personal information and to otherwise securely manage personal information.
    3. We may entrust subcontractors with the handling of personal information in whole or in part. In that case we will carry out necessary and appropriate supervision to ensure that the subcontractor carries out secure management of personal information.
  5. Disclosure, Correction, Addition, Deletion, Cessation of Use, Removal or Cessation of Provision of Personal Information to Third Parties
    1. When you would like to disclose, correct, add to, delete, have us cease the use of, remove or have us cease the provision of personal information (hereinafter “disclosure or the like”), directly contact “sanwacompany Personal Information Enquiry Desk” pursuant to the provisions of Section 6 below. Only when it is confirmed that the request relates to your personal information, we will respond the request for disclosure or the like, and notify you of that effect without delay.
    2. Notwithstanding the preceding paragraph, we may decide not to disclose all or part of your personal information in any of the following cases, and in that case we will notify you of a reason:
      • When the identity of the applicant cannot be verified (When the authority of representation of a representative cannot be verified);
      • When application forms are incomplete;
      • When we don’t have the information requested to be disclosed;
      • When the disclosure may be detrimental to the life, body, property or any other rights or interests of the applicant or third parties;
      • When the disclosure or the like may cause substantial hindrance to proper conduct of business of us; or
      • When the disclosure or the like constitute violation of other laws or regulations.
    3. Notwithstanding the provision of Section 5. (1), this provision does not apply in any case in which it is difficult to cease the use of or to remove your personal information and in which we take necessary alternative measures to protect your rights and interests.

      • Fee: 1,000 yen (including tax) per request.

    Please understand “Basic Principles” and “Handling of Personal Information” are subject to change without notice.
